Foundation List ("Foundation List," "we," "us," or "our") respects your privacy and is committed to protecting personal information collected through FoundationList.org and the websites, pages, services, job-board features, employer services, candidate services, communications, and other online services that we own or control (collectively, the "Services").

Foundation List serves users and organizations throughout all 50 United States. We intend this Policy to provide a nationwide framework for our privacy practices while also recognizing additional rights that may apply under state law.

- Professional, employment, education, resume, application, and job-search information;
- Employer, organization, job-posting, recruiting, and hiring-related information;

- Internet, browser, device, cookie, analytics, and website interaction information;
- Approximate location information derived from an IP address;
- Communications and information you voluntarily provide to us; and

Purposes for collection and use
We may collect and use these categories of information to operate Foundation List, provide job-board and account services, process transactions, communicate with users, administer job postings, maintain security, prevent fraud or abuse, improve the Services, perform analytics where permitted, provide advertising or marketing where permitted, comply with legal obligations, enforce our agreements and policies, and for other purposes described in this Policy or disclosed when information is collected.
Sale, sharing, and targeted advertising
Foundation List does not sell personal information for monetary consideration. Certain analytics, advertising, or similar technologies may constitute "sharing," "sale," or processing for targeted advertising under some state privacy laws even when no money is exchanged.
Where applicable law provides an opt-out right, Foundation List will honor qualifying requests and legally recognized opt-out signals as required by law.
Retention
We retain each category of personal information only for as long as reasonably necessary and proportionate for the purposes for which it was collected or another permitted business or legal purpose. Retention periods may vary based on the nature of the information, account or transaction history, legal and regulatory requirements, security needs, dispute resolution, contractual obligations, and applicable statutes of limitation.

Transaction and commercial information
If you purchase services from us, we may collect information concerning the transaction, services purchased, payment status, billing contact information, and related records.
Payment information may be processed by third-party payment processors. Foundation List may not directly receive or store complete payment-card information when it is processed by those providers.
Internet, device, and usage information

Foundation List does not request that users provide highly sensitive personal information through ordinary website forms, job postings, profiles, or communications unless the information is specifically requested and reasonably necessary for an authorized purpose.
Employers and other users must not request Social Security numbers, financial account credentials, medical information, government identification numbers, precise geolocation, biometric identifiers, or other sensitive personal information through a Job Posting unless collection is lawful, reasonably necessary for the legitimate employment process, appropriately secured, and permitted by Foundation List.
Where Foundation List processes information considered "sensitive data" or "sensitive personal information" under applicable law, we will obtain consent, provide applicable rights, restrict use, or otherwise process such information as required by law.
4. Sources of personal information
We may obtain personal information:
- Directly from you;
- From employers and organizations using Foundation List;
- Automatically from your browser or device;
- Through cookies and similar technologies;
- From service providers that support our operations;
- From publicly available sources;
- From referrals or communications sent to us; and
- From other sources permitted by applicable law.

6. Foundation List does not sell personal information for money
Foundation List does not sell personal information for monetary consideration.
We do not provide personally identifiable candidate or customer information to unrelated third parties for those parties to independently market their products or services to you.
Certain state privacy laws define "sale," "sharing," "cross-context behavioral advertising," or "targeted advertising" broadly. As a result, some uses of advertising, analytics, cookies, pixels, or similar technologies may potentially fall within those definitions even when Foundation List does not receive money in exchange for personal information.
Where applicable law provides an opt-out right, Foundation List will provide a method for exercising that right and will honor qualifying requests as required by law.
7. When we may disclose personal information
Service providers and contractors
We may disclose information to service providers and contractors that provide hosting, security, analytics, website functionality, payment processing, email delivery, customer support, technology, advertising, professional services, fraud prevention, and similar operational services.

Employers and organizations

California "Shine the Light"
California Civil Code Section 1798.83 may provide California residents with rights concerning disclosure of certain personal information to third parties for their own direct-marketing purposes.
Foundation List does not disclose personal information to unrelated third parties for those third parties' own direct-marketing purposes in the manner contemplated by this law.
16. Other state-specific privacy rights
Residents of states with comprehensive consumer privacy laws may have rights provided by their respective state laws.
Foundation List intends to honor qualifying privacy rights required under applicable U.S. state privacy laws. Where applicable law provides a right not specifically described in this Policy, Foundation List intends to process valid requests in accordance with that law.

Please identify the nature of your request and provide sufficient information for us to reasonably identify the information or account to which the request relates.
We may need to verify your identity before fulfilling certain requests. Information collected for verification may be used for purposes reasonably necessary to verify and process the request.
We will respond within the period required by applicable law.
Where permitted by law, an authorized agent may submit certain requests on your behalf. We may require evidence of the agent's authority and may need to verify your identity directly.
We may deny or limit a request where permitted by applicable law, including where we cannot reasonably verify identity or where an applicable legal exception applies.
18. Appeals
Residents of states providing a statutory right to appeal a decision concerning a privacy request may appeal an applicable decision by contacting info@foundationlist.org and identifying the communication as a Privacy Request Appeal.
We will review and respond to qualifying appeals as required by applicable law.

Foundation List retains personal information for as long as reasonably necessary and proportionate for the purposes for which it was collected, to provide requested Services, or for another legitimate business or legal purpose.

Information may be deleted, anonymized, aggregated, archived, or otherwise disposed of when no longer reasonably required, subject to applicable law and legitimate operational needs.
20. Data security
Foundation List uses reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, misuse, destruction, or loss.
No website, network, transmission method, database, or storage system can be guaranteed to be completely secure. Accordingly, Foundation List cannot guarantee absolute security.
Users are responsible for taking reasonable precautions when using online services and for protecting their account credentials, devices, and communications.
21. Information you choose to make public
Certain information submitted to Foundation List may be intended for public distribution, including job postings, organization information, logos, job locations, compensation information, URLs, and other employer-provided content.
Information intentionally published through a public Job Posting may be viewed, indexed, cached, copied, archived, or otherwise accessed by search engines, job-search services, third-party websites, archival services, aggregators, or members of the public.
Foundation List cannot control all copies of information lawfully obtained from public pages after the information has been published.
Employers and users are responsible for ensuring they have all necessary rights, permissions, consents, and lawful authority to submit information for publication.
22. Accuracy and availability of information
Users are responsible for providing accurate and current information.
Foundation List may correct, remove, archive, anonymize, restrict, or delete information as permitted by law and consistent with our legitimate business, security, operational, and legal requirements.
Unless required by law or expressly agreed otherwise, Foundation List does not guarantee that particular account information, Job Postings, communications, transaction records, or other information will be retained indefinitely.
23. Employers and third-party hiring practices
Foundation List provides a platform through which users may discover employment opportunities and interact with employers and other organizations.
Except where Foundation List expressly states otherwise, employers and other organizations are independent parties and are responsible for their own recruiting, interviewing, hiring, employment, privacy, security, recordkeeping, and legal practices.
Once you provide information directly to an employer or another third party, that organization's privacy policy, notices, agreements, and practices may govern its collection, use, disclosure, retention, and security of your information.
Foundation List does not control and is not responsible for the independent privacy, employment, security, or data-handling practices of employers or third parties, except to the extent responsibility cannot lawfully be excluded.
24. Third-party websites and services
Foundation List may contain links to employers, organizations, payment processors, service providers, social networks, advertising providers, or other independently operated websites and services.
Foundation List does not control the privacy or security practices of independently operated third parties.
When you leave Foundation List or interact directly with another organization, that organization's terms, privacy policy, and practices may apply.
We encourage users to review applicable third-party privacy policies before providing personal information.
25. Children's privacy
Foundation List is not directed to children.
Foundation List does not knowingly target or solicit personal information from children under 13 and does not knowingly permit the Services to be used for the purpose of collecting personal information from children in violation of applicable law.
Foundation List's employment and Job Posting services are intended for legitimate employment opportunities. It is against Foundation List policy for Job Postings to be specifically targeted toward children or teenagers under 18.
We reserve the right to remove or block postings directed toward minors where we determine they violate our policies or applicable law.
Parents and guardians are encouraged to take an active role in protecting children's privacy and security online.

26. Foundation List Job Postings
Foundation List Job Postings ("Job Postings") are designed to help nonprofit organizations and other eligible employers ("Customers") reach mission-driven candidates for employment opportunities.
The Customer is responsible for:
- All Job Posting content, including job descriptions, text, logos, trademarks, images, URLs, compensation information, and other materials included in the Job Posting; and
- Content, websites, property, and destinations to which a Job Posting directs users, including redirects ("Destinations").
Each Job Posting must relate to a bona fide employment opportunity and must not improperly solicit applications for unrelated positions.
Job Postings expire according to the applicable Job Posting order.
Customers may not copy, duplicate, scrape, reproduce, or republish a job from another hiring organization's website without that organization's prior knowledge and authorization.
If a hiring organization informs Foundation List that a Customer has posted its job without authorization, Foundation List reserves the right to remove the posting immediately, without prior notice and without a refund where permitted by applicable terms and law.
Customers may not, and may not enable or authorize another person to:
- Ask applicants for Social Security numbers, unlawfully protected information, illegal information, or sensitive information that is not reasonably appropriate to a legitimate hiring process;
- Create Job Postings without a reasonable and legitimate intent to hire for a bona fide open position;
- Create Job Postings targeted toward children or teenagers under 18;
- Intentionally misrepresent the job, responsibilities, compensation, hiring organization, location, employment relationship, or identity of the person posting the job;
- Create Job Postings merely to collect resumes or personal information without a bona fide intent to fill the advertised position;
- Fail to clearly disclose commission-based compensation or material nontraditional working conditions where omission would make the posting misleading;
- Post unlawful employment opportunities;
- Create Job Postings requiring applicants to make payments, recruit others, purchase memberships, or participate in opportunities resembling franchises, distributorships, clubs, multi-level marketing programs, or similar arrangements rather than legitimate employment;
- Provide identifiable candidate resume or application information to unauthorized parties;
- Sell, improperly disclose, harvest, scrape, or misuse applicant information;
- Spam or contact applicants for purposes unrelated to the employment opportunity;
- Harass, stalk, or continue contacting an applicant after the applicant has requested that contact stop;
- Create U.S. Job Postings without applicable federal or state employer identification or authorization where legally required;
- Create Job Postings that would prevent compliance with applicable employment, tax, wage, discrimination, background-check, privacy, or hiring laws;
- Require applicants to pay for employment;
- Solicit workers through intentional misrepresentation;
- Engage in recruitment or hiring practices that violate applicable federal, state, or local law;
- Use automated means, scraping, bots, crawlers, harvesting software, or data-extraction technologies to improperly access, download, query, copy, or collect Foundation List information;
- Copy, modify, or create unauthorized derivative works of Foundation List Job Postings, content, software, databases, or technology;
- Include malware, spyware, malicious code, or technologies intended to interfere with Foundation List or another device or system;
- Use Foundation List to engage in unlawful employment discrimination or practices violating applicable work-authorization or employment laws; or
- Engage in fraudulent, deceptive, abusive, illegal, or otherwise prohibited conduct.
27. Candidate and applicant information
Employers and other users receiving candidate information through Foundation List are responsible for handling that information lawfully, securely, and solely for legitimate employment-related purposes.
Candidate resumes, applications, contact information, and other identifiable applicant information must not be sold, improperly disclosed, harvested, scraped, republished, or used for unrelated solicitation.
Foundation List does not authorize employers or other users to use applicant information for purposes unrelated to legitimate recruiting, interviewing, hiring, or employment activities.
28. Employer and organization eligibility
Foundation List is designed primarily for nonprofit, philanthropic, educational, healthcare, association, government, public-sector, social-impact, and other mission-driven employment opportunities.
Foundation List may also permit recruiters, search firms, consultants, service providers, social enterprises, or other organizations whose opportunities or services Foundation List determines are relevant or appropriate for the mission-driven sector.
Foundation List reserves the right, in its reasonable discretion and subject to applicable law, to determine whether an organization, employer, opportunity, posting, account, advertisement, or use of the Services is appropriate for the platform.
Foundation List may refuse, suspend, remove, restrict, decline to publish, or discontinue content, accounts, postings, or access where Foundation List determines that the organization, opportunity, content, conduct, or activity is inconsistent with our mission, policies, legal obligations, platform integrity, users' interests, security requirements, or legitimate business interests.
29. Improper and unlawful conduct
Foundation List may collect, use, preserve, review, or disclose information when reasonably necessary to investigate, prevent, detect, document, or respond to suspected fraud, abuse, security incidents, prohibited conduct, unlawful activity, threats, unauthorized scraping, violations of Foundation List's agreements or policies, or misuse of the Services.
Foundation List reserves the right to investigate and decline, suspend, remove, or refuse to publish content or Job Postings that violate our policies, applicable law, or that we reasonably determine may create fraud, security, legal, reputational, user-safety, or operational concerns.
30. Email and communications
Foundation List may process communications as reasonably necessary to operate the Services, respond to the sender or intended recipient, provide support, maintain business records, investigate prohibited conduct, protect the Services, enforce our policies, or comply with applicable law.
We do not disclose private communications to unrelated third parties for their own independent marketing purposes.
31. Do Not Track
Some browsers provide a traditional "Do Not Track" ("DNT") setting.
Because there has historically not been a single universally adopted standard governing DNT signals, Foundation List may not respond to traditional DNT signals in all circumstances.
DNT is separate from legally recognized universal opt-out mechanisms such as Global Privacy Control. Where applicable law requires Foundation List to recognize a qualifying universal opt-out mechanism, we intend to honor that signal as required by law.
32. Automated technologies and future services
Foundation List may use technology to operate, organize, search, recommend, secure, moderate, or improve the Services.
If Foundation List adopts automated decision-making, profiling, artificial intelligence, or similar technologies in a manner that creates additional notice, consent, opt-out, risk-assessment, or other obligations under applicable law, Foundation List intends to provide legally required notices and rights.
Nothing in this section means that Foundation List currently uses automated technology to make legally significant hiring decisions about individuals.
33. Changes to this Privacy & Cookie Policy
Foundation List may update this Privacy & Cookie Policy from time to time to reflect changes to our practices, technologies, vendors, Services, business operations, or legal requirements.
When we make changes, we will update the "Last Updated" date at the top of this Policy.
Where required by applicable law, we will provide additional notice, obtain consent, or provide other legally required choices concerning material changes.
